Copyright is the right of the creator of an original work to publish and reproduce that work.

Intellectual property is the collective term for rights to intellectual creations, such as texts, photographs, software, inventions, brand names and valuable knowledge.
The essence is that only the person who owns an intellectual creation can make, record, publish, or reproduce it.

For higher education employees, the creator of a work is their employer. Who owns the copyright is determined by the collective agreement It is also stipulated in the (Dutch) Copyright Act:

Article 7 Copyright Act (translated from Dutch)
If the work performed in the service of another party consists of the creation of certain literary, scientific or artistic works, the party in whose service they were created shall be considered as their author, unless otherwise agreed between the parties.

Article E-7 of the CAO HBO
The employer is entitled to all copyrights and profits arising from the creation of a literary, scientific or artistic work as defined in the Copyright Act, if such creation is made or has been made by the employee in the performance of their duties for the employer.

Plagiarism is the act of copying another person's work, in whole or in part, without acknowledging the source, and intentionally or unintentionally presenting oneself as the original author.

To prevent plagiarism (intentional or unintentional), SURF offers a guideline for reusing material in Rules of Thumb for Plagiarism.

Ouriginal
In order to prevent students from cutting and pasting their papers without acknowledging their sources, we at HAN have been using Ouriginal since 1 December 2021. This software serves as a reference tool for assessing the authenticity of submitted work. Ouriginal is integrated in Handin (the HAN-wide applications for digital submission and digital grading of summative assignment-based exams). A submitted paper is automatically scanned for similarities to other papers (from universities or universities of applied sciences), online articles and other Internet sources. This requires no additional action on the part of the student. An assessor can access the Ouriginal report through Handin.

The Copyright Information Desk website is maintained by information specialists at the HAN Study Centres.
The Servicepunt Lesmateriaal (Insite) is responsible for organizing, managing and producing readers and other instructional materials, whether on paper (readers) or digitally (OnderwijsOnline and Teams), and for providing advice on the use of copyrighted materials.

The team of copyright experts also includes staff from Legal Affairs, ICT in Education, and Marketing, Communications and Public Relations.

Open content

Open Content is a collective term for creative works (such as text, images, sound, and video) that are published under a license that allows you to:

copy the work
share the work
and sometimes also edit the work

Are you using Open Content material? Then you're not violating any copyrights (unintentionally or otherwise).
